- when you interact with courses, groups, assignments, lectures, or other content within the Service;
- when we receive information from your educational institution, LMS, or authorized third-party integrations; and

"Personal information" or "personal data" means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked with a particular person or household, subject to applicable law.
2. Information We Collect
A. Information you provide directly
We may collect personal information you provide to us, including:
- your name, email address, username, password, and account credentials;
- profile information, such as school, class, group, role, or other profile details;
- information you submit when joining, creating, or managing classes, groups, lectures, assignments, or similar educational activities;
- content you upload, post, submit, or share through the Service, including questions, answers, messages, notes, files, and other user content;
- billing, subscription, and transaction-related information, which may be processed by our payment service providers;
- communications you send to us, including support requests and email correspondence; and
- any information you choose to provide when responding to surveys, feedback requests, or similar communications.
B. Information from schools, institutions, LMS providers, and other users
We may receive personal information about you from:
- your school, teacher, instructor, administrator, or other authorized educational user;
- your school's LMS or other educational technology systems;
- third-party single sign-on or identity providers you choose to use; and
- other users who invite you to join a class, group, or other Service activity.
This information may include class enrollment details, course or group membership, instructor information, roster information, and other information made available through an institutional or LMS integration.
C. Information collected automatically
When you use the Service, we and our service providers may automatically collect certain information, including:
- IP address;
- browser type, browser language, operating system, device identifiers, and device type;
- pages viewed, features used, links clicked, referring and exit URLs, and time spent using the Service;
- date and time of access;
- log, diagnostic, crash, and performance data;
- cookie identifiers and similar technology data; and
- approximate location information derived from IP address.
D. Cookies and similar technologies
We use cookies, local storage, pixels, SDKs, and similar technologies to:
- authenticate users and maintain sessions;
- remember preferences;
- keep the Service secure;
- measure traffic and usage patterns;
- troubleshoot and improve performance; and
- support analytics and product improvement.
You can control cookies through your browser or device settings. If you disable certain cookies, parts of the Service may not work properly.
3. How We Use Personal Information

- to support classes, groups, institutional deployments, and LMS integrations;
- to display profile, participation, and course-related information to appropriate users within the Service;

- to communicate with you about the Service, including transactional, administrative, security, and support messages;
- to personalize content and user experience;
- to analyze usage, performance, and trends;
- to detect, prevent, investigate, and respond to fraud, abuse, security incidents, and technical issues;
- to comply with legal obligations, enforce our agreements, and protect our rights, users, and the public; and
- for other disclosed purposes for which you provide consent where required by law.
We seek to limit our collection, use, and retention of personal information to what is reasonably necessary and proportionate for these purposes.
4. Visibility of Content and Profile Information
Certain information you provide through the Service may be visible to other authorized users in your school, class, institution, or group. For example:
- your name, role, and school or group affiliation may be visible to other authorized users;
- your questions, answers, comments, submissions, and related metadata may be visible within the class, group, or course context in which you participate; and
- if you create or manage a class or group, some course-related information may be visible to other participants as needed to operate the Service.

5. How We Disclose Personal Information
Squarecap does not sell student personal information and does not disclose student personal information to third parties for their own direct marketing, targeted advertising, or unrelated commercial purposes. We disclose personal information only as described in this Privacy Policy and only as reasonably necessary to operate the Service, support institutional use, fulfill contractual obligations, or comply with law.
A. Service providers and contractors
We may disclose personal information to vendors and service providers that perform services on our behalf, such as:
- cloud hosting and infrastructure providers;
- authentication, identity, and LMS integration providers;
- payment processors;
- analytics, monitoring, and support providers; and
- email and communication service providers.
These parties are authorized to use personal information only as needed to provide services to us or as otherwise permitted by applicable law.
B. Educational institutions and authorized users
If the Service is used through a school or institution, we may disclose personal information to that institution and to authorized instructors, administrators, and other users as necessary to provide and administer the Service.
C. Legal compliance and protection
We may disclose personal information:
- to comply with applicable law, regulation, legal process, subpoena, court order, or governmental request;
- to enforce our Terms or other agreements;
- to detect, investigate, or prevent fraud, abuse, security incidents, or other unlawful activity; or
- to protect the rights, property, safety, or security of Squarecap, our users, or others.
D. Business transactions
We may disclose personal information in connection with a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar corporate transaction, subject to applicable confidentiality and legal requirements.
E. With your direction or consent
We may disclose personal information where you direct us to do so or where you otherwise consent.
6. Educational Records, Student Data, and LMS Data
Squarecap is designed for educational use cases. When a school, college, university, or other educational institution uses the Service, Squarecap may process certain personal information on behalf of that institution.
When Squarecap processes student education records on behalf of a school or other educational institution subject to the Family Educational Rights and Privacy Act ("FERPA"), Squarecap does so under the institution's direction and only to provide authorized educational services, subject to applicable contracts and law.
Where we receive student, instructor, roster, course, or LMS-related information from an educational institution or LMS:
- we use that information only to provide and support the classroom response system and related educational Service functions requested by the institution;
- we may process the information under contractual instructions from the institution where applicable; and
- in some cases, the institution may control certain rights requests relating to that data.
Squarecap does not sell student personal information and does not use student personal information for targeted advertising or any purpose unrelated to providing the classroom response system and related educational Service functions.
If you believe your personal information was provided to Squarecap by your school or institution, you may also wish to contact that institution directly.
7. Children's Privacy
Protecting children's privacy is especially important.
Squarecap's services are intended for higher education and are not directed to children under 13. Squarecap does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register for the Service.
If we become aware that we have collected personal information from a child under age 13 without verification of parental consent, we will remove that information.

8. Analytics, Advertising, and Similar Technologies
We may use analytics and similar tools to understand how the Service is used, improve functionality, measure performance, and troubleshoot issues.
Squarecap does not sell student personal information and does not use student personal information for targeted advertising or cross-context behavioral advertising. Analytics and similar technologies are used to support security, product performance, service improvement, and operational troubleshooting, not to monetize student data or use it for unrelated commercial purposes.
We do not currently respond to browser "Do Not Track" signals in a uniform way, except where a legally recognized opt-out preference signal must be honored under applicable law.
9. Data Retention
We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to:
- provide the Service;
- maintain accounts and class or group functionality;
- comply with legal, tax, accounting, and reporting obligations;
- resolve disputes;
- enforce agreements; and
- detect, prevent, or investigate security incidents or misuse.
Retention periods may vary depending on the type of information, the nature of the relationship with the user or institution, the sensitivity of the information, and legal or operational requirements. When personal information is no longer reasonably needed, we will delete, deidentify, or securely dispose of it, subject to backup, archival, legal, and technical constraints.
10. Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, and disclosure. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.
11. International and Cross-Border Processing
Squarecap is based in the United States and may process and store personal information in the United States and other jurisdictions where we or our service providers operate.
If you access the Service from Canada or another jurisdiction outside the United States, your personal information may be transferred to, stored in, or accessed from the United States or other jurisdictions with different privacy or data-protection laws.
Where required by law, we will implement appropriate safeguards for cross-border processing.
12. Your Choices and Privacy Rights
A. General choices
You may:
- review, update, or correct certain account information by logging into your account, where available;
- opt out of marketing emails by using the unsubscribe instructions in those emails;
- manage cookies through browser or device settings; and
- contact us to request access, correction, or deletion, subject to applicable law and institutional constraints.
B. U.S. state privacy rights
Depending on your state of residence and subject to applicable law, you may have the right to:
- confirm whether we process your personal information;
- access personal information we hold about you;
- correct inaccuracies in your personal information;
- delete personal information;
- obtain a portable copy of certain personal information;
- opt out of targeted advertising;
- opt out of the sale of personal information;
- opt out of certain profiling decisions that produce legal or similarly significant effects; and
- appeal a denial of your privacy request.
If you are a California resident, you may also have rights to:

- request correction of inaccurate or incomplete personal information;
- withdraw consent where processing is based on consent, subject to legal or contractual restrictions and reasonable notice;
- complain to the Office of the Privacy Commissioner of Canada or another applicable regulator; and
- request information about our privacy practices.
D. Quebec-specific rights
If you are in Quebec, you may also have rights under applicable Quebec law, including rights to:

- request access to computerized personal information collected from you in a structured and commonly used technological format, where required by law;
- request correction of inaccurate, incomplete, or improperly collected personal information;
- request that we cease dissemination of certain personal information or de-index personal information in circumstances provided by law; and

The Service may contain links to third-party websites, services, or integrations. We are not responsible for the privacy, security, or data practices of third parties. Your use of third-party services is governed by their own terms and privacy policies.

We may update this Privacy Policy from time to time. If we make material changes, we will post the updated Privacy Policy and update the "Last Updated" date above. Where required by law, we will provide additional notice or obtain consent.
